5. Terms of Uploads

6. Submitted Content

7. Website Features

Access to the premium website features are only available to registered members.

8. Representations and Warranties

8.1 - Each party represents and warrants to the other party (i) that it has the full power and authority to enter into and perform under this Agreement, (ii) the execution and performance by it of its obligations under this Agreement do not constitute a breach of or conflict with any other agreement or arrangement by which it is bound, or any applicable laws, regulations or rules, and (iii) this Agreement is a legal, valid and binding obligation of the party executing this Agreement, enforceable in accordance with its terms and conditions.

8.2 - You represent and warrant to PearsonCommunications.com that any content you store on PearsonCommunications.com servers will not infringe the copyright, trademark, patent, trade secret, rights of privacy and publicity or other legal right of any third party.

9. Disclaimers, Exclusions And Limitations

9.1 - THE THIRD-PARTY LINKS, SERVICES, RESOURCES AND INFORMATION THAT PearsonCommunications.com PROVIDES ON OR MAKES AVAILABLE THROUGH THE PearsonCommunications.com WEB SITE ARE NOT CONTROLLED BY PearsonCommunications.com. 10. Third-Party Services

You will be governed by such terms and policies as well as the terms of this Agreement.

11. Additional Terms

The following agreements, rules and policies contain additional terms and conditions that govern your use of PearsonCommunications.com. PearsonCommunications.com reserves the right to make changes to such agreements, rules and policies at any time. Continued use of any part of PearsonCommunications.com constitutes your acceptance of such changes. Accordingly, you should review such agreements, rules and policies from time to time to become familiar with such changes. If the terms of any of the following conflict with the terms of this Agreement, the terms of this Agreement will govern and be given precedence.

12. Termination

12.1 - In its sole and absolute discretion, with or without notice to you, PearsonCommunications.com can (i) suspend or terminate your PearsonCommunications.com membership subscription, (ii) and remove any of your images or content from PearsonCommunications.com servers.

12.2 - If you are a Member, you may terminate your account for any reason at any time by sending an email to <strong>pearsoncommunications@pearsoncommunications.com.</strong> Please note that membership subscription termination will not necessarily result in your information being purged/terminated from PEARSON COMMUNICATIONS databases; just that you will no longer be able to access premium content and features on PEARSON COMMUNICATIONS. We will delete all information for a member at their request.

12.3 - This Agreement will survive indefinitely unless and until PearsonCommunications.com chooses to terminate it, regardless of whether any account you open is terminated by you or PearsonCommunications.com.

12.4 - If you or PearsonCommunications.com terminate your membership subscription, or if PearsonCommunications.com takes any action pursuant to Section 12.1, PearsonCommunications.com may delete any content on PearsonCommunications.com servers or otherwise in its possession and PearsonCommunications.com will have no liability to you or any third party for doing so.

13. Notices

All notices required or permitted to be given under this Agreement will be sent via email. No other format will be used. You can print the email and save it for your records. If PearsonCommunications.com provides notice to you, PearsonCommunications.com must use the contact information provided by you to PearsonCommunications.com.

14. Links

14.1 - The website may provide, or third parties may provide, links to other internet sites or resources. Because PEARSON COMMUNICATIONS has no control over such sites and resources, you acknowledge and agree that PEARSON COMMUNICATIONS is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that PEARSON COMMUNICATIONS shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

14.2 - PEARSON COMMUNICATIONS is not affiliated with any of the links and advertisements provided by Google. We don\'t support, associate or communicate with any company other than the links located on our links page. 15. Abuse

PEARSON COMMUNICATIONS administrators have full authority to terminate and disable accounts at any time for any reason. If administrators feel that a member is purposely abusing the system, their profile will get disabled or terminated.

16. Trademark Information

PEARSON COMMUNICATIONS trademarks and other PEARSON COMMUNICATIONS logos, photos, images and products names are the sole property of PEARSON COMMUNICATIONS. Without the prior permission from PearsonCommunications.com, you agree not to display or use in any manner, the PEARSON COMMUNICATIONS logos, photos, images. Purchasing the PEARSON COMMUNICATIONS t-shirt grants the purchaser use to wear and display the PEARSON COMMUNICATIONS logo.  It does not grant the purchaser, or anyone else, to duplicate and distribute the logo for profit or non-profit.

You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the website or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by PEARSON COMMUNICATIONS or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the site.

17. Notice For Copyright Or Intellectual Property Infringement
